Environmental Associations v. State (Constitutional Review of Civil Code Article on Ecological Damage)
Synthèse Legislator
Généré par l'IASeveral environmental associations filed an appeal concerning a decision regarding civil remedies against a company for environmental infractions and simultaneously raised a priority question of constitutionality regarding Article 1247 of the Civil Code. This article limits compensable ecological damage to "a non-negligible harm to the elements or functions of ecosystems or to the collective benefits derived by humans from the environment." The associations argued this limitation contradicts the constitutional Charter of the Environment, which mandates preventing harm, limiting consequences, and contributing to the repair of environmental damage without imposing a threshold on the gravity of the harm. The Criminal Chamber of the Court of Cassation found that this specific limitation concerning the severity of the environmental harm presents a new character in light of the evolving public debate on environmental issues, thus justifying a referral of the priority question of constitutionality to the Constitutional Council.

RENVOIE au Conseil constitutionnel la question prioritaire de constitutionnalité ;
