Employer Challenge to Article L. 242-1 Inadmissible Due to Unspecified Constitutional Claims
Synthèse Legislator
Généré par l'IAAn employer asserted that Article L. 242-1 of the Code relating to relations between the public and the administration manifestly and disproportionately infringed upon the constitutional rights and freedoms of both employers and employees. However, the Court of Cassation's Social Chamber declared the priority question of constitutionality inadmissible because the submission failed to present a specific question detailing which constitutional rights and freedoms were allegedly violated and how Article L. 242-1 constituted that infringement.

LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Attendu qu'aux termes de son mémoire distinct, l'employeur énonce que les dispositions de l'article L. 242-1 du code des relations entre le public et l'administration portent atteinte, de manière manifestement disproportionnée, aux droits et libertés que la Constitution garantit tant aux employeurs qu'aux salariés ;
Mais attendu qu'aucune question visant les droits et libertés garantis par la Constitution auxquels il serait porté atteinte et explicitant en quoi l'article L. 242-1 du code des relations entre le public et l'administration leur porterait atteinte n'est formulée ; que la question est irrecevable ;
PAR CES MOTIFS :
DÉCLARE IRRECEVABLE la question prioritaire de constitutionnalité ;
Ainsi fait et jugé par la Cour de cassation, chambre sociale, et prononcé par le président en son audience publique du neuf octobre deux mille dix-huit.
