Interruption of Appeal Proceedings Due to Party Liquidation
Synthèse Legislator
Généré par l'IAThe Supreme Court of Cassation was reviewing an appeal filed by a company against a judgment from the Court of Appeal of Metz that ordered it to pay lease fees for a commercial fund to another company acting as the judicial liquidator of a third company. The Court noted that a subsequent judgment from the Tribunal de Grande Instance of Metz pronounced the judicial liquidation of the appealing company itself, leading to the automatic interruption of the current appeal proceedings pursuant to the articles of the Code of Civil Procedure concerning the suspension of proceedings upon the liquidation of a party. Consequently, the Court declared the instance interrupted and set a four-month deadline for the parties to resume the proceedings, threatening dismissal of the appeal if this deadline was not met.
