Inadmissibility of Immediate Appeal of Procedural Incident Ruling
Synthèse Legislator
Généré par l'IAThe immediate appeal to the highest court was deemed inadmissible because the challenged decision, which resulted from an appeal against a decision by the preparatory judge, merely referred the appellant back to the preparatory judge to rule on a procedural incident concerning the lapse of the main appeal, and thus did not terminate the underlying proceedings. According to the applicable civil procedure code articles, final judgments that only rule on procedural exceptions, grounds for inadmissibility, or similar incidents, without ending the main action, are not immediately appealable unless specifically provided by law, and the contested decision did not constitute an overreach of power justifying an exception.

LA COUR DE CASSATION, DEUXIÈME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur la recevabilité du pourvoi, contestée par la défense :
Vu les articles 606, 607 et 608 du code de procédure civile ;
Attendu que les jugements en dernier ressort qui se bornent à statuer sur une exception de procédure, une fin de non-recevoir ou tout autre incident, sans mettre fin à l'instance, ne peuvent être frappés de pourvoi en cassation, indépendamment des jugements sur le fond, que dans les cas spécifiés par la loi ;
Attendu que l'arrêt attaqué, statuant sur le déféré de l'ordonnance d'un conseiller de la mise en état, a renvoyé M. X... à saisir le conseiller de la mise en état d'un incident tendant à voir constater la caducité de la déclaration d'appel sur le fondement de l'article 902 du code de procédure civile ;
Que cette décision n'a pas mis fin à l'instance ;
D'où il suit que le pourvoi immédiat contre cet arrêt, qui n'est pas entaché d'excès de pouvoir, n'est pas recevable ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du code de procédure civile, rejette sa demande et le condamne à payer la somme de 3 000 euros à la société Technique solaire ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du dix novembre deux mille seize.
