Request for Judicial Recall Rejected Due to Lack of Procedural Error
Synthèse Legislator
Généré par l'IAThe requesting party argued that the Supreme Court's decision relied on an error of law raised ex officio that should have resulted in the decision being overturned, but the Court found that the objections merely contested the Court's assessment of the asserted ground of appeal, which was already ruled unfounded. Consequently, the requisite conditions for a judicial recall, which demand a procedural error not attributable to the applicant, were not met, leading to the rejection of the request for a recall of the judgment.

LA COUR DE CASSATION, DEUXIÈME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que la société requérante fait valoir que la Cour de cassation a fondé son arrêt sur un moyen relevé d'office qui n'était pas de nature à justifier la décision attaquée et devait, au contraire, conduire à sa censure et au renvoi de l'affaire devant la juridiction de fond ;
Mais attendu que l'arrêt critiqué ayant statué sur le moyen du pourvoi pour le déclarer non fondé, les critiques susmentionnées ne tendent, en réalité, qu'à contester l'appréciation portée par la Cour de cassation sur ledit moyen ; que les conditions d'un rabat d'arrêt, qui suppose l'existence d'un erreur de procédure qui ne soit pas imputable au demandeur, ne sont donc pas réunies ;
Que la requête doit être rejetée ;
PAR CES MOTIFS :
DIT n'y avoir lieu à rabat d'arrêt ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du trois novembre deux mille seize.
