Supreme Court Denies Request for Interpretation on Scope of Partial Annulment
Synthèse Legislator
Généré par l'IAThe Supreme Court rejected a request for interpretation concerning its prior decision, which had partially quashed a lower court's ruling from November 4, 2014, by setting aside only the portion that dismissed a claim regarding the formation of a contract. The Court reasoned that there was no ambiguity regarding the scope of the partial annulment, as it explicitly confined the cassation only to the aspect concerning the claim about the contract's formation, thereby rendering the subsequent request for interpretation unnecessary.

LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Vu la requête susvisée ;
Vu l'arrêt rendu le 18 mars 2016 prononçant la cassation partielle d'un arrêt de la cour d'appel de Nîmes du 4 novembre 2014 et renvoyant les parties devant la cour d'appel de Montpellier ;
Attendu qu'il n'existe aucune ambiguïté sur la portée de la cassation qui annule l'arrêt mais seulement en ce qu'il déboute M. X... de sa demande au titre de la formation ;
Qu'il s'ensuit que la requête doit être rejetée ;
PAR CES MOTIFS :
REJETTE la requête ;
Condamne la société Manpower aux dépens ;
Ainsi fait et jugé par la Cour de cassation, chambre sociale, et prononcé par le président en son audience publique du sept juillet deux mille seize.
