Succession Liability and Prescription of Guarantor's Debt (Constitutional Review)
Synthèse Legislator
Généré par l'IAFollowing the death of an individual who had acted as a personal guarantor for a loan to a company, the successor spouse, acting for herself and her minor child who had accepted the inheritance subject to the net assets, opposed the creditor bank's claim by invoking the extinction of the debt under the provisions of Article 792, paragraph 2, of the Civil Code. The Court of Cassation determined that the challenge to this article, concerning the prescription of the creditor's right to claim against the heir who accepts the inheritance only up to the net assets, was applicable to the dispute and presented a serious question regarding an alleged violation of the right to property guaranteed by Article 2 of the Declaration of the Rights of Man and of the Citizen, leading to a referral of the priority question of constitutionality to the Constitutional Council.

LA COUR DE CASSATION, PREMIÈRE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que Philippe X..., qui s'était porté caution solidaire pour le remboursement d'un prêt consenti par la société BNP Paribas à la société Frédéric X... Unipessoal, est décédé le 28 juin 2010, laissant pour lui succéder son épouse, Mme Y..., et son fils alors mineur, Baldric X... ; que, le 20 janvier 2011, Mme Y..., agissant tant en son nom qu'en celui de son enfant mineur, a déclaré accepter la succession à concurrence de l'actif net ; que la société BNP Paribas a assigné M. Baldric X... et Mme Y...en paiement des sommes restant dues en vertu de ce prêt, avant de déclarer sa créance, le 16 juillet 2014, au domicile élu de cette dernière ; que, pour s'opposer à la demande, M. Baldric X... et Mme Y...ont invoqué l'extinction de la créance de la banque par application des dispositions de l'article 792, alinéa 2, du code civil ;
Attendu que le tribunal a transmis la question prioritaire de constitutionnalité ainsi rédigée :
" Les dispositions de l'article 792, alinéa 2, du code civil portent-elle atteinte aux droits et libertés garantis par les articles 2 et 17 de la Déclaration des droits de l'homme et du citoyen du 26 août 1789 dont la valeur constitutionnelle a été reconnue par la décision du Conseil constitutionnel du 16 janvier 1982 ? " ;
Attendu que la disposition contestée est applicable au litige ;
Qu'elle n'a pas déjà été déclarée conforme à la Constitution dans les motifs et le dispositif d'une décision du Conseil constitutionnel ;
Et attendu que la question posée présente un caractère sérieux en ce qu'elle invoque une atteinte au droit de propriété garanti à l'article 2 de la Déclaration des droits de l'homme et du citoyen du 26 août 1789 ;
PAR CES MOTIFS :
RENVOIE au Conseil constitutionnel la question prioritaire de constitutionnalité ;
Ainsi fait et jugé par la Cour de cassation, première chambre civile, et prononcé par le président en son audience publique du six juillet deux mille seize.
