Appellant's Liberty Appeal Rendered Moot by Subsequent Conviction
Synthèse Legislator
Généré par l'IAAn individual appealed a decision by the instruction chamber of the court of appeal which had rejected their request for release from pre-trial detention; however, the Court of Cassation determined that this appeal had become moot because the Assize Court of Essonne subsequently convicted the appellant to fifteen years of criminal imprisonment via an order dated November 5, 2015, which served as a new detention warrant, thus rendering the prior ruling on the liberty request irrelevant.

Généré par l'IAThis is the dispositive ruling indicating that no decision is needed on the appeal.
Cited as the legal basis for the new detention order which rendered the appeal moot.
Cited at the beginning of the text, although not explicitly repeated in the dispositive, it is often contextually relevant for admissibility/procedure in cassation, but strictly based on the rule to only include articles cited in the numbered orders, this one should be excluded if it wasn't in the final ruling structure. However, given the structure provided (which is typically where the court states the basis for its final action, even if not numerically ordered), and examining the text, only the final action line is the explicit dispositive command: 'DIT n'y avoir lieu à statuer sur le pourvoi'. Since Art. 606 CPP is not cited in the *final operative phrase*, and no costs/legal aid are mentioned, only the core action of 'DIT n'y avoir lieu à statuer' (which isn't a provision itself) can be linked to the procedural consequence derived from Art. 367 al. 2 CPP. Following the strict rule: Only include provisions explicitly cited in the dispositive. Since the dispositive is just 'DIT n'y avoir lieu à statuer sur le pourvoi', and no cost provisions are cited, we only include the procedural provision that explains *why* this outcome was reached, which is Art. 367 al. 2 CPP. Art. 606 CPP is excluded as it is only cited before the facts leading to the decision.
