Cassation Declines Referral on Labor Code Remuneration Statute
Synthèse Legislator
Généré par l'IAThe Court of Cassation declined to refer a priority question of constitutionality concerning Article L. 6325-9 of the Labor Code, which governs the remuneration of professional training contract holders, to the Constitutional Council, finding that the question was neither new nor serious. The appellant argued that the article violated constitutional principles of equality and non-discrimination by not extending the benefit of provisions (presumably regarding higher minimum remuneration) to contract holders in companies governed by an enterprise agreement when the relevant sector only had a collective or branch agreement, or when no collective agreement existed. The Court reasoned that the principle of equality permits the legislature to treat dissimilar situations differently and that the challenged article guarantees all contract holders at least the minimum wage (SMIC), while applying a more favorable regime when a collective or branch agreement sets a higher minimum, thus finding no characterization of the alleged constitutional breaches.

Mais attendu, d'une part, que la question, ne portant pas sur l'interprétation d'une disposition constitutionnelle dont le Conseil constitutionnel n'aurait pas encore eu l'occasion de faire application, n'est pas nouvelle ;
Et attendu, d'autre part, que la question posée ne présente pas un caractère sérieux ; qu'en effet, le principe d'égalité ne s'oppose pas à ce que le législateur règle de façon différente des situations qui ne sont pas identiques ; que l'article L. 6325-9 du code du travail garantit à tous les salariés sous contrat de professionnalisation une rémunération au moins égale au SMIC, tout en organisant l'application du régime de faveur lorsque l'entreprise concernée relève d'une convention collective ou d'un accord de branche fixant une rémunération minimale conventionnelle ; que les atteintes aux principes constitutionnels invoqués ne sont pas caractérisées ;
D'où il suit qu'il n'y a pas lieu de la renvoyer au Conseil constitutionnel ;
PAR CES MOTIFS :
DIT N'Y AVOIR LIEU DE RENVOYER au Conseil constitutionnel la question prioritaire de constitutionnalité ;
