Appeal Dismissal for Untimely Reply Conclusions Following Incidental Appeal
Synthèse Legislator
Généré par l'IAIn an appeal proceeding following an initial judgment, the appellants and intervener filed reply conclusions on October 28, 2013, after the appellees had filed an incidental appeal on May 2, 2013. The court, acting as the judge in charge of preparing the case, ruled that the appellants' conclusions of October 28, 2013, were entirely inadmissible based on Article 910 of the Code of Civil Procedure, which grants a party responding to an incidental appeal two months from the notification of the incidental appeal conclusions to file their own, holding that the statute does not distinguish between conclusions that merely supplement the main appeal and those that reply to the incidental appeal, and therefore, all conclusions filed outside the two-month window following the incidental appeal must be deemed inadmissible to avoid creating complex, case-by-case distinctions.
