Expropriation Annulment Appeal Stayed Pending Administrative Decision
Synthèse Legislator
Généré par l'IAThe applicant appealed an expropriation order transferring ownership of their property to a public land establishment, seeking its annulment as a consequence of an ongoing administrative appeal against the underlying declaration of public utility and expropriation decree. The Court of Cassation ordered the appeal to be stayed (radiated) because the resolution of the appeal depended entirely on the outcome of the administrative proceedings, and since no final decision from the administrative court had been presented, the matter would be reinstated only upon the production of that irrevocable decision or proof of withdrawal from the administrative proceedings within a two-month period.
