Synthèse Legislator
Généré par l'IAThe case involved an appeal lodged by the guardian of an individual against a decision from the Court of Appeal concerning a condominium association, but the proceeding was subsequently affected by the death of the represented person, who was the appellant's ward. Following the death, the Court of Cassation had granted extensions for the parties to resume the proceedings, but as neither party took the required procedural step within the stipulated timeframe, the Court ordered the immediate radiation (dismissal/striking off) of the appeal, pursuant to article 376 of the Code of Civil Procedure, while reserving the allocation of costs.
