Referral on Commercial Code Article Regarding Legal Certainty and Equality Dismissed
Synthèse Legislator
Généré par l'IAThe case concerned a priority question of constitutionality challenging Article L. 223-14 of the Commercial Code, which was alleged to violate the fundamental principle of legal certainty concerning limited liability companies and the principle of equality. The highest court determined that the question was not novel, as the challenged provision had not previously been subject to interpretation by the Constitutional Council regarding the asserted constitutional principles. Furthermore, the court reasoned that the contested provision did not infringe upon the principles of legal certainty or equality before the law, concluding that the question lacked a serious nature in light of the invoked constitutional requirements, and therefore dismissed the referral to the Constitutional Council.

Attendu que la disposition contestée est applicable au litige ; qu'elle n'a pas déjà été déclarée conforme à la Constitution dans les motifs et le dispositif d'une décision du Conseil constitutionnel ;
Mais attendu, d'une part, que la question, ne portant pas sur l'interprétation d'une disposition constitutionnelle dont le Conseil constitutionnel n'aurait pas encore eu l'occasion de faire application, n'est pas nouvelle ;
Et attendu, d'autre part, que la disposition critiquée ne porte aucune atteinte au principe de sécurité juridique non plus qu'à celui de l'égalité devant la loi ; que la question posée ne présente donc pas de caractère sérieux au regard des exigences qui s'attachent aux principes de valeur constitutionnelle invoqués ;
D'où il suit qu'il n'y a pas lieu de la renvoyer au Conseil constitutionnel ;
PAR CES MOTIFS :
DIT N'Y AVOIR LIEU A RENVOYER au Conseil constitutionnel la question prioritaire de constitutionnalité ;
Ainsi fait et jugé par la Cour de cassation, chambre commerciale, financière et économique, et prononcé par le président en son audience publique du vingt-sept septembre deux mille treize.
