Synthèse Legislator
Généré par l'IAThe applicant lodged an appeal in cassation against a commercial court judgment that confirmed an order for payment, ordered the termination of a contract due to the applicant's fault, and awarded damages. The Court of Cassation declared the appeal inadmissible because the judgment, by ruling on the claim for contract termination, addressed an indeterminate demand, rendering the judgment subject to appeal rather than immediately appealable to the Court of Cassation under the relevant procedural articles governing final judgments.

LA COUR DE CASSATION, DEUXIÈME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur la recevabilité du pourvoi, examinée d'office après avis donné aux parties en application de l'article 1015 du code de procédure civile :
Vu l'article 605 du code de procédure civile, ensemble l'article 40 du même code ;
Attendu que le pourvoi en cassation n'est ouvert qu'à l'encontre des jugements rendus en dernier ressort ;
Attendu, selon le jugement attaqué, que la société Hemera, qui avait fait opposition devant un tribunal de commerce à une ordonnance portant injonction de payer qui l'avait condamnée à payer une certaine somme à la société DB communication, s'est pourvue en cassation contre le jugement qui a confirmé l'ordonnance, prononcé la résolution du contrat à ses torts exclusifs et l'a condamnée à des dommages-intérêts ;
Mais attendu que le jugement, en statuant sur la demande de résolution du contrat formée par la société DB communication, a statué sur une demande indéterminée, de sorte qu'il était susceptible d'appel ;
D'où il suit que le pourvoi n'est pas recevable ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi ;
Condamne la société Hemera aux dépens ;
Vu l'article 700 du code de procédure civile, rejette la demande ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du seize mai deux mille treize.
