Agricultural Social Security Fund Seizure and Public Procurement Constitutionality Challenge
Synthèse Legislator
Généré par l'IAIn a dispute arising from real estate seizure proceedings initiated by a private agricultural social security fund for unpaid contributions, the debtors raised a priority question of constitutionality concerning whether the rural code articles granting these private entities public service procurement mandates, without prior adherence to public tendering obligations, violated the principles of free access to public procurement and equal treatment guaranteed by the Declaration of the Rights of Man and of the Citizen. The court refused to refer the question to the Constitutional Council because the seizure was based on irrevocable titles, rendering the alleged unconstitutionality of the contested provisions inapplicable to the resolution of the current litigation.

LA COUR DE CASSATION, DEUXIÈME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que la mutualité sociale agricole de Franche-Comté ayant engagé des poursuites de saisie immobilière contre M. et Mme X... pour le non-paiement de cotisations sociales, ceux-ci ont contesté la saisie et présenté devant la Cour de cassation, par un mémoire écrit, distinct et motivé, une question prioritaire de constitutionnalité ;
Attendu que la question est ainsi rédigée :
« Les articles L. 723-1, L. 723-2 et L. 725-3 du Code rural en ce qu'ils confient aux caisses de mutualité sociale agricole, personnes morales de droit privé, des marchés publics de services sans respect préalable des obligations en matière de passation des services publics portent-ils atteinte au principe de liberté d'accès à la commande publique et d'égalité de traitement des candidats, garantis par les articles 6 et 14 de la Déclaration de 1789, et par conséquent, sont-ils contraires à la Constitution ? » ;
Mais attendu que la saisie étant poursuivie sur le fondement de titres irrévocables, l'inconstitutionnalité alléguée des dispositions contestées, inapplicables à ce litige, serait dépourvue d'incidence sur sa solution ;
D'où il suit qu'il n'y a pas lieu de renvoyer la question prioritaire de constitutionnalité au Conseil constitutionnel ;
PAR CES MOTIFS :
DIT N'Y AVOIR LIEU DE RENVOYER au Conseil constitutionnel la question prioritaire de constitutionnalité ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du vingt-cinq avril deux mille treize.
