LA COUR DE CASSATION, TROISIÈME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que, par acte déposé au greffe de la Cour de cassation le 17 septembre 2012, la SCP Potier de La Varde et Buk-Lament, avocat à la Cour de cassation, a déclaré au nom de M. et Mme X... se désister du pourvoi formé par eux contre un arrêt rendu le 19 avril 2011 par la cour d'appel de Caen, au profit de l'Association syndicale des propriétaires du Parc résidentiel de la Corniche, M. et Mme Y..., M. Z... et M. A... ;
Que ce désistement, intervenu après le dépôt du rapport, doit, aux termes de l'article 1026 du code de procédure civile, être constaté par arrêt ;
PAR CES MOTIFS :
DONNE acte à M. et Mme X... du désistement de leur pourvoi ;
Condamne M. et Mme X... aux dépens ;
Vu l'article 700 du code de procédure civile, rejette les demandes ;
Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du vingt-trois octobre deux mille douze.
