Employer Appeals on Labor Claims Barred by Jurisdictional Misclassification
Synthèse Legislator
Généré par l'IAThe employer appealed several lower court decisions concerning claims by employees for back wages and by a union for damages, where the total amount of these claims exceeded the maximum appealable threshold set for the labor tribunals by the relevant labor code article. The Court of Cassation declared the appeals inadmissible because the initial judgments, despite the high monetary value involved, were incorrectly classified as being in the final resort jurisdiction of the labor tribunals, thus making the subsequent appeals to the Court of Cassation procedurally impermissible under the relevant articles governing appealability and jurisdiction.
