Nous, Catherine LECAPLAIN-MOREL, président de la chambre sociale, magistrat chargé d'instruire l'affaire,

Vu les dispositions des articles 396, 397, 399, 400, 401, 403, 405 et 945 du code de procédure civile,

Vu l'appel en date du 15 juillet 2010 interjeté par l'urssaf de la mayenne à l'encontre du jugement prononcé par le tribunal des affaires de securité sociale de laval, en date du 8 juillet 2010,

Vu l'arrêt de la cour d'appel d'Angers en date du 21 juin 2011 de sursis à statuer, dans l'attente du prononcé d'arrêts de la Cour de Cassation,

Vu le courrier reçu au greffe de la cour d'appel le 3 août 2011 par lequel l'URSSAF DE LA MAYENNE indique se désister de l'instance d'appel,

Vu la lettre du conseil du CCAS du Horps, FOYER-LOGEMENT "LES HORTENSIAS" reçue également à la cour, le 21 septembre 2011, par laquelle il indique l'accord de l'intimé au désistement formé par l'appelante,

PAR CES MOTIFS,

Donnons acte à l' URSSAF DE LA MAYENNE de son désistement.

Constatons l'extinction de l'instance et le dessaisissement de la cour et condamnons l' URSSAF DE LA MAYENNE aux dépens, sous réserve d'un éventuel accord des parties.
