Synthèse Legislator
Généré par l'IAThe Court of Cassation received an intervention from a commercial entity and was asked to rule on a Priority Question of Constitutionality concerning Article L. 442-6 III, paragraph 2, of the Commercial Code, which allows the Minister of Economy to seek the nullity of illicit clauses or contracts and demand restitution without the participation or consent of the concerned supplier. The court found that the challenged provision was applicable to the dispute, had not previously been ruled upon by the Constitutional Council, and raised a serious question regarding the constitutional guarantees of individual liberties, specifically the rights of defense, the right to bring an action, and property rights as protected by the Declaration of the Rights of Man and of the Citizen, thus necessitating a referral to the Constitutional Council.

LA COUR DE CASSATION, CHAMBRE COMMERCIALE, a rendu l'arrêt suivant :
Reçoit la société Carrefour France en son intervention ;
Attendu que la disposition contestée est applicable au litige ;
Qu'elle n'a pas déjà été déclarée conforme à la Constitution dans les motifs et le dispositif d'une décision du Conseil constitutionnel ;
Que la question posée présente un caractère sérieux au regard du principe de garantie des libertés individuelles édicté par l'article 16 de la Déclaration des droits de l'homme de 1789 et du droit de propriété, garanti par les articles 2 et 17 de la même Déclaration ;
D'où il suit qu'il y a lieu de la renvoyer au Conseil constitutionnel ;
PAR CES MOTIFS :
RENVOIE au Conseil constitutionnel la question prioritaire de constitutionnalité ;
