Civil Party Appeal Against Indictment Division Decision Deemed Inadmissible
Synthèse Legislator
Généré par l'IAThe civil party appealed a decision by the indictment division of the Court of Appeal which had declared their appeal inadmissible regarding a decision of inadmissibility by the investigating judge concerning allegations of forgery and use thereof against an unnamed person. The Court of Cassation declared the appeal inadmissible because the personal memorandum submitted by the civil party, who was not criminally convicted, was transmitted directly to the Court of Cassation without being filed with the registry of the indictment division or being presented through a lawyer admitted to practice before the Court of Cassation, thus failing to comply with the procedural requirements of Article 584 of the Code of Criminal Procedure, and failing to present any admissible grounds for appeal under Article 575 by a civil party against a decision of the indictment division when the public prosecutor has not appealed.

LA COUR DE CASSATION, CHAMBRE CRIMINELLE, en son audience publique tenue au Palais de Justice à PARIS, le vingt-sept mars deux mille un, a rendu l'arrêt suivant :
Sur le rapport de M. le conseiller PALISSE et les conclusions de M. l'avocat général LAUNAY ;
Statuant sur le pourvoi formé par :
- X... Roger, partie civile,
contre l'arrêt de la chambre d'accusation de la cour d'appel de PARIS, en date du 10 octobre 2000, qui, sur sa plainte, contre personne non dénommée du chef de faux et usage, a déclaré irrecevable l'appel formé contre l'ordonnance d'irrecevabilité rendue par le juge d'instruction ;
Sur sa recevabilité :
Vu le mémoire personnel produit ;
Attendu que ce mémoire, qui émane d'un demandeur non condamné pénalement, n'a pas été déposé au greffe de la chambre d'accusation, mais a été transmis directement à la Cour de Cassation, sans le ministère d'un avocat en ladite Cour ;
Que, dès lors, ne répondant pas aux exigences de l'article 584 du Code de procédure pénale, il ne saisit pas la Cour de Cassation des moyens qu'il pourrait contenir ;
Et attendu qu'il n'est ainsi justifié d'aucun des griefs que l'article 575 dudit Code autorise la partie civile à formuler à l'appui de son pourvoi contre un arrêt de chambre d'accusation, en l'absence de recours du ministère public ;
Par ces motifs,
DECLARE le pourvoi IRRECEVABLE ;
Ainsi jugé et prononcé par la Cour de Cassation, chambre criminelle, en son audience publique, les jour, mois et an que dessus ;
Etaient présents aux débats et au délibéré, dans la formation prévue à l'article L.131-6, alinéa 4, du Code de l'organisation judiciaire : M. Cotte président, M. Palisse conseiller rapporteur, M. Joly conseiller de la chambre ;
Avocat général : M. Launay ;
Greffier de chambre : Mme Lambert ;
En foi de quoi le présent arrêt a été signé par le président, le rapporteur et le greffier de chambre ;
