Amnesty Law and Exclusion of Civic Rights Interdiction
Synthèse Legislator
Généré par l'IAThe appellant sought the rectification of a prior ruling, asserting that an interdiction on civic rights imposed by a 1995 judgment should be extinguished by the Amnesty Law of August 3, 1995. The appellate court had rejected this request, agreeing with the Prosecutor General that the civic rights interdiction was explicitly excluded from the scope of the amnesty law under Article 18-II, 4 thereof. Consequently, the Supreme Court dismissed the appeal, affirming that because the specific civic rights penalty was excluded by the text of the amnesty legislation, the lower court was correct in denying the motion for extinguishment.

Statuant sur le pourvoi formé par :

contre l'arrêt de la cour d'appel de BASSE-TERRE, chambre correctionnelle, en date du 5 janvier 1999, qui a rejeté sa demande en rectification d'erreur matérielle, a fait droit à celle du procureur général et a dit que l'amnistie ne s'appliquait pas à l'interdiction des droits civiques ;
Vu le mémoire personnel produit ;
Sur le premier moyen de cassation, pris de la violation des dispositions de la loi du 3 août 1995, portant amnistie ;
Attendu que le demandeur ne saurait faire grief à la cour d'appel d'avoir rejeté sa requête, fondée sur la loi du 3 août 1995, tendant a faire constater l'amnistie de l'interdiction des droits civiques prononcée par arrêt du 2 mai 1995, dès lors que cette peine était exclue de la loi précitée par son article 18-II,4 ;
Qu'ainsi le moyen doit être rejeté ;
Sur le second moyen de cassation, pris de la violation de l'article 121-1 du Code pénal ;
Attendu que ce moyen, qui ne critique pas les dispositions de l'arrêt frappé de pourvoi, est irrecevable ;
Et attendu que l'arrêt est régulier en la forme ;
REJETTE le pourvoi ;
Ainsi jugé et prononcé par la Cour de Cassation, chambre criminelle, en son audience publique, les jour, mois et an que dessus ;
