Parking Fine Legality in Concession Dispute
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected the appeals filed by the public prosecutor and an individual who was fined for parking violations by the Nice police court. The individual appealed the decision, arguing that the municipal decree forming the basis of the prosecution was illegal because the management of paid parking had been illegally conceded by the city to a mixed-economy company. The police court rejected this defense, stating that the legality of the operating conditions of the paid parking zone, which were challenged by the appellant, were irrelevant to the legality of the specific municipal decree on which the prosecution was based, and the court reasoned that since the legality of the decree itself was not contested, its decision was properly justified.

Sur le rapport de M. le conseiller référendaire POISOT et les conclusions de M. l'avocat général DINTILHAC ;
Statuant sur les pourvois formés par :
- L'OFFICIER DU MINISTERE PUBLIC PRES LE TRIBUNAL D'INSTANCE DE NICE, - X... Roland, contre le jugement dudit tribunal de police, du 19 février 1996, qui, pour infractions à la réglementation sur le stationnement des véhicules, a condamné Roland X... à 2 amendes de 75 francs ;
1° - Sur le pourvoi du ministère public :
Attendu qu'aucun moyen n'est produit ;
2° - Sur le pourvoi de Roland X... :
Vu le mémoire personnel produit ;
Sur le moyen unique de cassation pris de la violation des articles 384 et 593 du Code de procédure pénale et 4 du Code pénal ;
Attendu que, pour rejeter l'exception soulevée par Roland X... qui invoquait l'illégalité de la concession, par la ville de Nice, à une société d'économie mixte, de la gestion du stationnement payant, le tribunal de police retient que cette exception vise seulement les conditions d'exploitation de la zone de stationnement payant, qui sont étrangères à la cause, et non l'arrêté municipal du 3 octobre 1989, qui sert de fondement aux poursuites, et dont la légalité n'est pas contestée par le prévenu ;
Qu'en prononçant ainsi, le tribunal a justifié sa décision sans encourir les griefs allégués ;
D'où il suit que le moyen ne saurait être accueilli ;
Et attendu que le jugement est régulier en la forme ;
REJETTE les pourvois ;
Ainsi jugé et prononcé par la Cour de Cassation, chambre criminelle, en son audience publique, les jour, mois et an que dessus ;
Etaient présents aux débats et au délibéré : M. Guilloux conseiller le plus ancien, faisant fonctions de président en remplacement du président empêché, M. Poisot conseiller rapporteur, MM. Massé, Fabre, Mme Baillot, MM. Le Gall, Farge, Mme Anzani conseillers de la chambre, Mme Batut conseiller référendaire ;
Avocat général : M. Dintilhac ;
Greffier de chambre : Mme Nicolas ;
En foi de quoi le présent arrêt a été signé par le président, le rapporteur et le greffier de chambre ;
