Mother Convicted for Denying Father Visitation Rights
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal against a lower court decision that convicted the appellant of failing to present her child, in violation of a prior matrimonial court order granting visitation rights to the father. The appellate court found that the mother's refusal to present the child in June, October, and November 1988 was established, and rejected her defense based on a moral constraint arising from the conviction that the father posed a risk to the child, as these allegations had already been dismissed by the matrimonial judge when denying her request to suspend visitation rights. The Court of Cassation affirmed this reasoning, concluding that the lower court had correctly established the material and intentional elements of the offense and applied the law correctly.

Généré par l'IAThis article defines the offense (non-représentation d'enfant) for which the accused was convicted, as the court found the elements of this offense were met.
This article is cited in the rejected ground of appeal, indicating its procedural relevance to the decision on the merits, although the court ultimately rejected the appeal.
This article was cited in the ground of appeal that the court implicitly dismissed by finding the main ground unfounded.
This article is not present in the text. The costs provision mentioned is 'Condamne la demanderesse aux dépens' which corresponds to provisions of the Code of Criminal Procedure or general principles, not LTF (which is Swiss Federal Supreme Court law). Since no specific French procedural article for costs is cited in the operative part, no provision is extracted for costs based on the rules given (which require citation in the dispositive).

LA COUR DE CASSATION, CHAMBRE CRIMINELLE, en son audience publique tenue au Palais de Justice à PARIS, le douze juin mil neuf cent quatre vingt dix, a rendu l'arrêt suivant :
Sur le rapport de M. le conseiller DARDEL, et les conclusions de M. l'avocat général ROBERT ;
Statuant sur le pourvoi formé par :
X... Yvette,
contre l'arrêt de la cour d'appel de RENNES, chambre correctionnelle, en date du 19 mai 1989, qui, pour non représentation d'enfant, l'a condamnée à un mois d'emprisonnement et à des réparations civiles ;
Vu le mémoire personnel produit ;
Sur le moyen unique de cassation, pris de la violation des articles 64, 357 du Code pénal et 593 du Code de procédure pénale ;
Attendu qu'il résulte de l'arrêt attaqué que pour déclarer Yvette X... coupable du délit prévu et d réprimé par l'article 357 du Code pénal, la cour d'appel relève qu'il est établi que tant au mois de juin 1988 qu'en octobre 1988 et novembre 1988, la prévenue, mère du jeune Frédéric X... a refusé de représenter ce mineur à Eric Y... au mépris d'une ordonnance du juge aux affaires matrimoniales en date du 20 novembre 1987 ; qu'elle énonce en outre qu'Yvette X... ne saurait justifier son comportement en invoquant une contrainte morale constituée par la conviction que le père se serait livré à des agissements préjudiciables à l'enfant dès lors que ces allégations déjà portées au soutien d'une demande tendant à priver Y... de tous droits sur le mineur ont été écartées par le juge aux affaires matrimoniales qui a débouté Yvette X... de sa requête en suspension du droit de visite ;
Attendu qu'en l'état de ces énonciations répondant aux articulations essentielles de la défense, les juges ont caractérisé en tous leurs éléments matériels et intentionnel les infractions reprochées à la demanderesse et ont fait l'exacte application de la loi ;
Qu'il s'ensuit que le moyen n'est pas fondé ;
Et attendu que l'arrêt est régulier en la forme ;
REJETTE le pourvoi ;
Condamne la demanderesse aux dépens ;
Ainsi jugé et prononcé par la Cour de Cassation, chambre criminelle, en son audience publique, les jour, mois et an que dessus ;
Où étaient présents : M. Le Gunehec président, M. Dardel conseiller rapporteur, MM. Berthiau, Zambeaux, Dumont, Fontaine, Milleville, Alphand, Carlioz, Culié conseillers de la chambre, Mme Guirimand, M. Nivôse conseillers référendaires, M. Robert avocat général, Mme Ely greffier de chambre ;
