Civil Party Appeal on Intentional Assault and Battery Dismissed for Procedural Non-Compliance
Synthèse Legislator
Généré par l'IAThe civil party appealed a decision by the Court of Appeal of Paris that declared their civil claim inadmissible in a prosecution for intentional assault and battery, but the Court of Cassation rejected the appeal because the supporting brief, dated after the appeal was filed and submitted directly to the Court of Cassation without representation by counsel, failed to comply with the procedural requirements of articles 584 and 585 of the Code of Criminal Procedure, meaning no grounds for appeal were properly invoked before the court.
