AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :

Attendu que, par acte déposé au greffe de la Cour de cassation le 25 avril 2007, la SCP Gatineau, avocat à la Cour de cassation, a déclaré au nom de la société Arkema se désister du pourvoi par elle formé contre un arrêt rendu le 30 juin 2006 par la cour d'appel de Lyon, au profit de M. X... et de la Caisse primaire d'assurance maladie de Lyon ;

Que ce désistement, intervenu après le dépôt du rapport, doit, aux termes de l'article 1026 du nouveau code de procédure civile, être constaté par arrêt ;

PAR CES MOTIFS :

DONNE ACTE à la société Arkema du désistement de son pourvoi ;

Condamne la société Arkema aux dépens ;

Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du douze juin deux mille sept.
