Inadmissibility of Main and Incidental Appeals Due to Lack of Standing and Service
Synthèse Legislator
Généré par l'IAThe Court of Cassation declared the main appeal inadmissible because the appellant, which had its voluntary intervention in the underlying proceedings previously declared inadmissible by a final decision, was not a party to the case, citing Article 609 of the New Code of Civil Procedure. Consequently, the incidental appeals filed by other parties were also deemed inadmissible pursuant to Articles 611-1 and 979 because they failed to demonstrate that the attacked decision had been served upon them, and the inadmissibility of the main appeal rendered the incidental appeals inadmissible as well.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur la recevabilité du pourvoi principal, examinée d'office après avis donné aux avocats :
Vu l'article 609 du nouveau code de procédure civile ;
Attendu que la société HLM Vaucluse Logement a formé un pourvoi en cassation contre un arrêt rendu au fond dans une instance dans laquelle son intervention volontaire avait été déclarée irrecevable par un précédent arrêt devenu irrévocable ; que la société HLM Vaucluse Logement n'étant pas partie à l'instance, son pourvoi n'est pas recevable ;
Vu les articles 611-1 et 979 du nouveau code de procédure civile ;
Attendu que les parties ayant formé un pourvoi incident ne justifiant pas de la signification à leur égard de l'arrêt attaqué, l'irrecevabilité du pourvoi principal entraîne l'irrecevabilité des pourvois incidents ;
PAR CES MOTIFS :
DECLARE IRRECEVABLES les pourvois ;
Condamne la société HLM Vaucluse Logement aux dépens des pourvois ;
Vu l'article 700 du nouveau code de procédure civile, condamne la société HLM Vaucluse Logement à payer la somme de 2 000 euros à M. Y... ; rejette les autres demandes ;
Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du dix juillet deux mille sept.
