Conditional Removal of Expropriation Appeal Pending Administrative Ruling
Synthèse Legislator
Généré par l'IAAn individual appealed an expropriation judge's order transferring ownership of a parcel of land to a municipality, seeking the annulment of that order as a consequence of the administrative court's potential annulment of the declaration of public utility and transferability decree. Because the resolution of this administrative appeal was decisive for examining the appeal before the civil court and no final decision from the administrative matter had been brought to the court's attention, the Court of Cassation ordered the appeal to be removed from the active docket, with reinstatement conditional upon the production of the irrevocable administrative ruling or proof of withdrawal from that related proceeding.
