Syndicat v. New Property Owners (Failure to Notify Transfer)
Synthèse Legislator
Généré par l'IAThe court upheld a decision ruling that a homeowners' association (syndicat) was not at fault for failing to summon new property owners to a general assembly because the owners had not formally notified the association of the transfer of their lots, as required by the relevant decree, even though the association was aware of the sale through correspondence sent to the new owners. The appellate court correctly reasoned that in the absence of the required notification of the property transfer, the association had no legal obligation to send the assembly convocation to the purchasers.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant relevé que le syndicat, créancier des débiteurs initiaux, ne connaissait pas l'identité exacte des acquéreurs, que bien que n'ayant pas été destinataire de l'avis de mutation prévu à l'article 6 du décret du 17 mars 1967, il avait pu malgré cela adressé aux époux X... plusieurs courriers le 13 septembre 2000, portant la mention "vente par M. Y... ou Mme Z... à M. X...", la cour d'appel, qui avait constaté qu'à l'époque de la convocation à lassemblée générale du 23 octobre 2000, les époux X... n'avaient pas notifié au syndic la mutation des lots conformément à l'article 6 décret du 17 mars 1967, en a exactement déduit qu'en l'absence d'un telle notification, le syndic n'avait pas à les convoquer à cette assemblée ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne les époux X... aux dépens ;
Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du vingt-six septembre deux mille sept.
