AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que M. De X... a saisi le premier président de la cour d'appel de Paris d'une requête aux fins d'être autorisé à prendre à partie les magistrats composant la 23e chambre, section B de cette cour d'appel ; que M. de X... fait grief à l'ordonnance attaquée (Paris, 30 novembre 2006), d'avoir déclaré sa requête irrecevable ;
Mais attendu que les dispositions des articles 505 et suivants du code de procédure civile, relatives à la prise à partie, ont cessé de recevoir application, en ce qui concerne les magistrats du corps judiciaire, depuis l'entrée en vigueur de l'article 11-1 ajouté à l'ordonnance du 22 décembre 1958 par la loi organique du 18 janvier 1979, texte d'où il résulte que désormais la responsabilité de ces magistrats, à l'occasion de leurs fautes personnelles se rattachant au service public de la justice, ne peut être engagée que sur l'action récursoire de l'Etat ; d'où il suit que le recours ne peut être accueilli ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le recours ;
Condamne M. De X... aux dépens ;
Ainsi fait et jugé par la Cour de cassation, première chambre civile, et prononcé conformément à l'article 452 du nouveau code de procédure civile par M. Pluyette, conseiller le plus ancien en ayant délibéré, en remplacement de M. le président Ancel, en son audience publique du dix-neuf septembre deux mille sept.
