Co-owner's Appeal on Rural Lease Rent Revision Dismissed
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal concerning a request for revision of a rural lease agreement, where one co-owner of indivised land, leased in its entirety to his brother in 1974, sought to adjust the rent for his half share. The appellate court correctly found that because the authentic lease instrument listed all parcels as being leased to the brother without distinguishing between the co-owners' respective halves of the indivision, the request for rent revision by the appellant was inadmissible, a finding the Court of Cassation upheld as based on a proper interpretation of the facts without distortion.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant constaté que toutes les parcelles appartenant à l'indivision formée entre MM. X... et Y... Z... étaient énumérées dans l'acte authentique de bail rural du 9 avril 1974 comme affermées au profit de M. Y... Z..., la cour d'appel, qui a retenu à bon droit, sans dénaturation et sans se contredire, qu'il était impossible de procéder à une distinction entre la moitié appartenant à M. X... Z... et la moitié appartenant à son frère Y..., a, justement déduit de ces seuls motifs, que la demande de révision du fermage formée par M. X... Z... était irrecevable ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne, ensemble, M. X... et Mme Monique Z... et Mme A... aux dépens ;
Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du deux octobre deux mille sept.
