Liquidator Termination of Apprentice Contract and AGS Liability
Synthèse Legislator
Généré par l'IAThe liquidator of a company terminated an apprentice's contract shortly after the commencement of judicial liquidation, leading to a dispute over the apprentice's compensation and whether the guarantee institution (AGS) was liable. The challenging party argued that the apprentice was only entitled to damages for the prejudice caused by the termination, not the full remaining salary of the contract term, citing the Labor Code. However, the Court of Cassation upheld the lower court's decision, ruling that because the liquidator terminated the contract within 15 days of the judicial liquidation, the apprentice was entitled to an indemnity equal to the remuneration they would have received until the end of the contract, and this claim was enforceable against the AGS.

Généré par l'IAThe court confirmed the Court of Appeal's decision regarding the indemnity due for the termination of the apprenticeship contract, which was the central issue raised by the ground for appeal citing this article.
The appellant argued that the Court of Appeal violated this article by awarding full remuneration instead of mere prejudice, but the Supreme Court found the ruling consistent with this article.
The AGS de Paris and UNEDIC d'Annecy were ordered to pay the costs.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Attendu que le mandataire liquidateur de la société Symtek a mis fin, par lettre du 22 juillet 2002, au contrat d'apprentissage de Melle X... ;
Attendu qu'il est fait grief à l'arrêt attaqué (Chambéry, 1er juillet 2004) d'avoir fixé, au passif de l'employeur, une somme à titre de dommages-intérêts pour rupture du contrat d'apprentissage et d'avoir déclaré sa décision opposable à l'AGS alors, selon le moyen, que l'apprenti dont le contrat a été rompu par le mandataire liquidateur du fait de la liquidation judiciaire de l'employeur, ne peut prétendre à une indemnisation égale aux rémunérations qu'il aurait perçues jusqu'au terme de son contrat, mais seulement à la réparation de son préjudice consécutif à la rupture ; qu'en décidant le contraire, la cour d'appel a violé l'article L. 117-17 du code du travail ;
Mais attendu que la cour d'appel a exactement décidé que le liquidateur ayant mis fin au contrat d'apprentissage dans les 15 jours de la liquidation judiciaire, l'apprentie avait droit à une indemnité égale aux rémunérations qu'elle aurait perçues jusqu'au terme de son contrat et que sa créance était garantie par l'AGS ; que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne l'AGS de Paris et l'UNEDIC d'Annecy aux dépens ;
Ainsi fait et jugé par la Cour de cassation, chambre sociale, et prononcé par le président en son audience publique du vingt-deux mars deux mille sept.
