Court of Cassation Quashes Decision Over Improper Use of Summary Proceedings in Labor Dispute with Factual Dispute
Synthèse Legislator
Généré par l'IAIn a decision based on an appeal concerning a labor law matter, the highest court found that the appellate court, ruling in summary proceedings, overstepped its jurisdiction because the employees' request was met with a serious dispute regarding the cause of the termination, which is prohibited under the relevant labor code article governing summary proceedings. Consequently, the Court of Cassation quashed the lower court's decision without referral, concluding that summary proceedings were inappropriate given the serious factual dispute, and ruled that no further summary hearing was necessary.
