Appeal Inadmissibility Regarding Non-Final Judgment on Sign Removal Claim
Synthèse Legislator
Généré par l'IAThe appeal was deemed inadmissible because the filing party appealed a lower court judgment that addressed an unspecified claim seeking the removal of a sign, a decision which, absent any contrary provision, remains subject to further appeal rather than being immediately appealable to the Court of Cassation as a final judgment. The Court of Cassation relied on articles stating that an appeal to the highest court is only open against judgments rendered in the final instance, and that a judgment ruling on an indeterminate claim is generally open to appeal.

Vu les articles 40 et 605 du nouveau code de procédure civile ;
Attendu que le pourvoi en cassation n'est ouvert qu'à l'encontre des jugements rendus en dernier ressort ; que le jugement qui statue sur une demande indéterminée est, sauf disposition contraire, susceptible d'appel ;
Attendu que M. X... s'est pourvu en cassation contre un jugement qui, statuant sur une demande indéterminée tendant à faire condamner son adversaire à déposer l'enseigne qu'il avait fait installer sur un immeuble, est susceptible d'appel ;
D'où il suit que le pourvoi n'est pas recevable ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau code de procédure civile, rejette la demande de M. Y... ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du huit février deux mille sept.
