Lessor v. Lessee: Occupation Indemnity with Precarity Coefficient for Premature Lease Termination
Synthèse Legislator
Généré par l'IAThe Court of Cassation upheld a lower court's decision, which had determined the occupation indemnity owed by a lessee following the termination of a lease initiated by the lessors. The appellate court justified its ruling by noting that the premature termination prevented the normal amortization of investments made by the tenant within the preceding nine years, especially given the high-end nature of the business ("a top-ranking palace") operating in a highly competitive environment facing legal uncertainty that hindered necessary investments for maintaining top-tier status; consequently, the court applied a "precarity coefficient" to the occupation indemnity, the amount of which was determined at its discretion.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le premier moyen, ci-après annexé :
Attendu qu'ayant relevé, par motifs propres et adoptés, que du fait de la rupture du bail à l'initiative des bailleurs, l'amortissement des investissements réalisés depuis moins de neuf ans par le preneur n'avait pu s'effectuer normalement et qu'il y avait également lieu de tenir compte de la qualité du commerce considéré, en l'occurence "un palace de haut rang", soumis à une concurrence très exigeante qui a connu depuis plusieurs années une situation d'incertitude juridique ne lui permettant pas d'envisager les investissements nécessaires au classement en tête de l'hôtel parmi les palaces de neige, la cour d'appel en a déduit que l'indemnité d'occupation due par la société Le Byblos à compter du 1er décembre 1993 devait être affectée d'un coefficient de précarité dont elle a souverainement fixé le montant ;
D'où il suit que le moyen n'est pas fondé ;
Et attendu qu'il n'y a pas lieu de statuer sur les autres moyens dont aucun ne serait de nature à permettre l'admission du pourvoi ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Capon-Pinet aux dépens ;
Vu l'article 700 du nouveau code de procédure civile, condamne la société Capon-Pinet à payer à la société anonyme Le Byblos la somme de 2 000 euros et aux sociétés La Douna et Alphée la somme de 2 000 euros ; rejette la demande de la société Capon-Pinet ;
Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du vingt mars deux mille sept.
