Property Liquidation and Occupation Indemnity Prescription Period
Synthèse Legislator
Généré par l'IAFollowing the divorce of the parties, an issue arose regarding the liquidation of the former marital property, specifically a building, which led to a dispute over the former husband's exclusive occupation of the property and the former wife's claim for occupation indemnity. The appellant argued that the claim for indemnity was time-barred under the five-year limitation period specified in the Civil Code concerning the fruits and revenues of undivided property, claiming the lower court wrongly accepted a claim for indemnity dating back to 1998 when the initial claim was made in 2003. The Court of Cassation rejected the appeal, affirming the appellate court's reasoning that the five-year prescription period for the indemnity claim did not begin to run until the divorce judgment became final (June 15, 1996), making the claim, limited to the five years preceding the filing of the claim in 2003, admissible for the period after the judgment became final.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, pris en ses diverses branches :
Attendu que M. X... et Mme Y... se sont mariés et ont divorcé en Italie ; que le président du tribunal de grande instance de Bobigny a ordonné, le 9 novembre 1999, l'exequatur de la décision italienne de divorce ; qu'un immeuble, situé à Bobigny, dépend de la communauté ayant existé entre les époux ; que le notaire n'ayant pu dresser l'état liquidatif, le tribunal de grande instance de Bobigny a désigné un expert afin de déterminer la valeur du bien et a constaté que la demande d'indemnité d'occupation formée par l'épouse était prescrite ;
1 / que la cour ne pouvait déclarer l'action de Mme Y... recevable, l'article 815-10 du code civil, seul applicable en la cause spécifiant "aucune recherche relative aux fruits et revenus ne sera recevable plus de cinq ans après la date à laquelle ils ont été perçus ou auraient du l'être" ; que la cour constatant que les revenus litigieux étaient dus à compter du 15 juin 1996 et qu'aucune demande n'avait été formulée avant le 15 juin 2001 ne pouvait dire l'action recevable fut-ce en limitant sa portée (violation de l'article 815-10 du code civil) ;
2 / que, subsidiairement, la cour ne pouvait à la fois dire prescrite la période juin 1996 juin 2001 et déclarer la demande fondée depuis le 23 mai 1998 (contradiction de motifs : articles 455, 458 du nouveau code de procédure civile) ;
Mais attendu qu'après avoir relevé que la prescription n'avait commencé à courir, relativement à la durée de l'instance, qu'à compter du jour où le jugement de divorce était passé en force de chose jugée, soit le 15 juin 1996, c'est à bon droit et sans se contredire, que la cour d'appel a déclaré recevable, pour la période courant après le jugement, la demande d'indemnité de Mme Y... concernant les fruits produits par l'indivision post-communautaire, dans la limite des cinq ans précédant sa première demande, faite dans des conclusions du 23 mai 2003 ; que le moyen n'est fondé en aucune de ses branches ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de cassation, première chambre civile, et prononcé par le président en son audience publique du vingt février deux mille sept.
