Appeal Regarding Enforcement Order and Periodic Fine Amount
Synthèse Legislator
Généré par l'IAAn individual appealed a lower court judgment that ordered them, under penalty of a periodic fine, to remove and trim a hedge, even though the appellate court noted the initial obligations had become moot. The appealing party challenged the confirmation of the judgment and the refusal to reduce the fine amount. The high court dismissed the appeal, reasoning that challenging the decision to impose or maintain the periodic fine constituted an attack on the lower court's discretionary power regarding the penalty, which cannot be re-litigated before the Court of Cassation under the guise of procedural violations.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur les trois moyens réunis, tels que reproduits en annexe :
Attendu, selon l'arrêt attaqué (Reims, 17 juin 2004 ), qu'un appel a été interjeté à l'encontre d'un jugement d'un tribunal d'instance, déclaré exécutoire par provision, ayant condamné Mme X..., sous peine d'astreinte, à procéder à l'arrachage et à l'élagage d'une haie ;
Attendu que Mme X... fait grief à l'arrêt d'avoir confirmé le jugement tout en constatant que les condamnations étaient devenues sans objet et d'avoir rejeté sa demande de réduction du montant de l'astreinte ;
Mais attendu que, sous le couvert d'une prétendue violation des articles 33, 34 et 36 de la loi n° 91-650 du 9 juillet 1991 et 455 du nouveau code de procédure civile, le moyen ne tend qu'à remettre en discussion devant la Cour de cassation l'appréciation, par la cour d'appel, de l'opportunité de confirmer la décision d'assortir la décision de condamnation d'une astreinte, qui relève du pouvoir discrétionnaire du juge ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Vu l'article 700 du nouveau code de procédure civile, rejette la demande de Mme X... ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du vingt-trois novembre deux mille six.
