Creditor v. Tenant: Attachment-Distribution and Failure to Respond
Synthèse Legislator
Généré par l'IAFollowing an attachment-distribution against an individual carried out by a creditor in the hands of the debtor's tenant, the creditor sued the tenant for payment; the tenant appealed, arguing that the law did not require an immediate response and that the subsequent decree imposing such an obligation exceeded the scope of the law, thereby violating the requirement for a responsive judgment. The Supreme Court rejected the appeal, holding that the lower court was justified in ruling against the tenant because it found that the tenant had failed to fulfill the obligation to provide information immediately or within a reasonable subsequent period without a legitimate reason, rendering the tenant's arguments about the legality of the decree inoperative.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu, selon l'arrêt attaqué (Poitiers, 8 juin 2004), que Mme X... a fait pratiquer une saisie-attribution au préjudice de M. Y... entre les mains de son locataire, M. Z... ; qu'elle a ensuite assigné ce dernier en paiement des causes de la saisie ;
Attendu que M. Z... fait grief à l'arrêt d'avoir accueilli cette demande, alors, selon le moyen, que dans ses conclusions d'appel il soutenait que la loi du 9 juillet 1991 n'exigeait pas que la réponse soit donnée sur-le-champ et que le décret du 31 juillet 1992, qui avait été pris en exécution de ladite loi, ne pouvait mettre à la charge du tiers saisi une obligation non prévue par la loi ; qu'en ne répondant pas à ces conclusions, la cour d'appel a violé l'article 455 du nouveau code de procédure civile ;
Mais attendu qu'ayant relevé que M. Z... n'avait satisfait à son obligation de renseignement ni sur-le-champ ni ultérieurement, dans un délai raisonnable, et retenu qu'il ne justifiait pas d'un motif légitime, la cour d'appel, qui n'était pas tenue de répondre à des conclusions que ses constatations rendaient inopérantes, a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. Z... aux dépens ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du neuf novembre deux mille six.
