Commercial Dispute Admissibility Upheld on Prior Claim Withdrawal
Synthèse Legislator
Généré par l'IAAn appellant company challenged a commercial court's decision that had ordered it to pay a sum to another company, with the appellate court subsequently declaring the second company's action inadmissible. The high court upheld this decision because the prior action before another commercial court, which had involved a written withdrawal of the claim by the second company, showed no record of an oral modification to that demand at the hearing, thus legally justifying the declaration of inadmissibility; furthermore, the appellant's argument regarding the prior court's jurisdiction was deemed inadmissible on appeal as it was a new argument not previously raised.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu, selon l'arrêt attaqué (Versailles, 28 février 2005), que la société Gotteland et Guery, actuellement dénommée Eiffage construction Centre, a interjeté appel d'un jugement du tribunal de commerce de Chartres l'ayant condamnée à payer une certaine somme à la société Cepra ;
Sur les premier et deuxième moyens réunis, tels que reproduits en annexe :
Attendu que la société Cepra fait grief à l'arrêt d'avoir déclaré son action irrecevable ;
Mais attendu que l'arrêt relève que le tribunal de commerce d'Evreux, devant lequel une action avait précédemment été engagée aux mêmes fins, était saisi de conclusions écrites de désistement d'action de la part de la société Cepra et qu'il ne résulte ni du jugement ni du registre d'audience que cette société ait modifié oralement sa demande à l'audience ; que par ces seuls motifs, la cour d'appel a, hors de toute dénaturation, légalement justifié sa décision ;
Sur le troisième moyen, tel que reproduit en annexe :
Attendu que la société Cepra fait grief à l'arrêt d'avoir statué comme il l'a fait ;
Mais attendu qu'il ne résulte ni de l'arrêt ni des productions que la société Cepra ait soutenu devant la cour d'appel que le tribunal de commerce d'Evreux était incompétent pour connaître de l'action engagée par elle ;
D'où il suit que le moyen, nouveau et mélangé de fait et de droit, est comme tel irrecevable ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Cepra aux dépens ;
Vu l'article 700 du nouveau code de procédure civile, rejette les demandes respectives des parties ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du vingt-trois novembre deux mille six.
