Supreme Court Dismisses Premature Appeal on Employee College Seat Allocation Agreement
Synthèse Legislator
Généré par l'IAThe Supreme Court declared an appeal inadmissible because the lower court's decision, which concerned the validity of an agreement on seat allocation between employee colleges prior to staff delegate elections, was interlocutory and could be challenged before the election judge, whose ruling would then be subject to a final appeal to the Supreme Court. The appeal sought to overturn a lower court judgment that upheld the impugned allocation agreement, but under the relevant labor code provisions, such preliminary disputes are channeled through the specialized election judge procedure, rendering the direct appeal to the Supreme Court premature and thus inadmissible.

LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Sur la fin de non-recevoir soulevée par la défense :
Vu les articles L. 423-15 et L. 433-11 du code du travail ;
Attendu que la décision du tribunal d'instance statuant avant les élections sur la validité d'un accord prévoyant la répartition des sièges entre les collèges, n'est pas susceptible de pourvoi en cassation dès lors que cette contestation peut être portée devant le juge de l'élection dont la décision peut être frappée de pourvoi ;
Attendu que le syndicat CGT TEPF a formé un pourvoi contre un jugement du tribunal d'instance d'Orthez du 11 avril 2006 qui a rejeté sa requête en annulation de l'accord conclu le 3 mars 2006 prévoyant cette répartition en vue des élections des délégués du personnel ; que cette contestation pouvant être portée devant le juge de l'élection le pourvoi est irrecevable ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi ;
Ainsi fait et jugé par la Cour de cassation, chambre sociale, et prononcé par le président en son audience publique du six décembre deux mille six.
