Divorce on Shared Fault and Denial of Compensatory Allowance
Synthèse Legislator
Généré par l'IAThe appellant challenged a decision that granted a divorce based on the shared fault of both parties, arguing the lower court failed to explicitly state that the appellant's grave insults, repeated violations of marital obligations, lazy behavior, and concerning conduct made common life intolerable. The Supreme Court rejected this ground, finding that the appellate court, by sovereignly assessing the facts of the appellant's conduct as constituting grave insults and repeated violations of marital duties, correctly applied the relevant civil code article by pronouncing a divorce on shared fault. Additionally, the court upheld the denial of a compensatory allowance, reasoning that given the brief duration of the marriage and the appellant's age and capacity to work, an allowance was unwarranted.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le premier moyen, ci-après annexé :
Attendu que Mme X... fait grief à l'arrêt confirmatif attaqué (Metz, 13 septembre 2005) d'avoir prononcé le divorce aux torts partagés ;
Attendu qu'après avoir, par motifs adoptés, souverainement estimé que la paresse de Mme X..., ses agressions verbales à l'encontre de son mari, son comportement perturbé, intéressé et ambigu, caractérisaient des injures graves et des violations répétées des obligations du mariage, la cour d'appel, bien qu'elle n'ait pas précisé que ces faits rendaient intolérable le maintien de la vie commune, a fait une exacte application de l'article 242 du code civil en prononçant le divorce aux torts partagés ; qu'elle a, par ce seul motif, légalement justifié sa décision ;
Sur le second moyen, ci-après annexé :
Attendu que Mme X... reproche à l'arrêt de l'avoir déboutée de sa demande de prestation compensatoire ;
Attendu qu'ayant constaté que la vie commune n'avait duré que quelques mois et que l'épouse, âgée de 34 ans au moment de la séparation était en état d'occuper un emploi, la cour d'appel en a souverainement déduit qu'il n'y avait pas lieu de lui allouer une prestation compensatoire ; que le moyen ne peut être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Ainsi fait et jugé par la Cour de cassation, première chambre civile, et prononcé par le président en son audience publique du vingt-deux février deux mille sept.
