Nightclub Assault Damages Appeal
Synthèse Legislator
Généré par l'IAAn individual sued a nightclub employee and the operating company for damages after being struck in the face during an altercation. The defendants appealed the decision that condemned them to compensate the victim for personal prejudice, arguing the appellate court improperly itemized damages. The high court rejected the appeal, reasoning that the appellate court acted within its sovereign power by independently itemizing the compensation for aesthetic damage, loss of enjoyment, and pain endured, without being bound to follow the specific argumentation of the parties.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, tel que reproduit en annexe :
Attendu, selon l'arrêt attaqué (Pau, 16 mai 2005), qu'au cours d'une altercation, M. X..., portier de la discothèque "Le Paradis", exploitée par la société du même nom, a frappé M. Y... au visage ; que celui-ci a fait assigner M. X... et cette société en responsabilité et indemnisation de son préjudice devant le tribunal de grande instance ;
Attendu que M. X... et la société Le Paradis font grief à l'arrêt de les avoir condamnés à payer à M. Y... une certaine somme en réparation de son préjudice personnel ;
Mais attendu que c'est dans l'exercice de son pouvoir souverain que la cour d'appel, qui n'était pas tenue de suivre les parties dans le détail de leur argumentation, a procédé à l'indemnisation distincte du préjudice esthétique, du préjudice d'agrément et des souffrances endurées ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Vu l'article 700 du nouveau code de procédure civile, rejette la demande de la société Le Paradis ;
Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du sept décembre deux mille six.
