A primary health insurance fund sought repayment from a medical specialist for an overpayment concerning continuous, twenty-four-hour chemotherapy perfusion sessions, part of which was conducted in an outpatient setting rather than full hospitalization. The lower court had overruled the demand, reasoning that the continuity of treatment beginning in the hospital and finishing at home, combined with the ambiguity regarding the nomenclature exclusion of portable or implantable pumps, justified an assimilation for billing. However, the Court of Cassation quashed this decision, holding that the general nomenclature for professional acts strictly limits the reimbursement of chemotherapy perfusion sessions to those performed within a structure possessing cancer expertise, explicitly excluding reimbursement for perfusions via portable or implantable pumps, thereby validating the social security organization's claim for the difference in billing corresponding to the outpatient portion of the treatment.

AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :

Sur le moyen unique :

Vu les articles L. 133-4, L. 321-1 et R. 162-52 du code de la sécurité sociale, ensemble les articles 5 et 7 des dispositions générales et l'article 3, section II, chapitre V, titre II de la nomenclature générale des actes professionnels, annexée à l'arrêté du 27 mars 1972 ;

Attendu qu'il résulte de la combinaison de ces textes que les séances de perfusion dans le cadre d'une chimiothérapie anticancéreuse ne peuvent donner lieu à remboursement que dans les conditions fixées à la nomenclature générale des actes professionnels ;

Attendu, selon le jugement attaqué, rendu en dernier ressort, que la caisse primaire d'assurance maladie a notifié à M. X..., médecin spécialiste en oncologie médicale, un indu pour des séances de perfusion d'une durée de vingt-quatre heures réalisées dans le cadre d'une chimiothérapie anticancéreuse, au motif que le traitement avait été partiellement réalisé en structure ambulatoire et non en hospitalisation complète ;

Attendu que, pour accueillir le recours du praticien et annuler la contrainte, le tribunal retient qu'il s'agit de séances de chimiothérapie continues, commencées en milieu hospitalier et terminées au domicile des patients, que l'exclusion par la nomenclature générale des actes professionnels des perfusions par pompes portables ou implantables vise tout à la fois les cotations K 20 et K 30 et qu'il convient de coter par assimilation ;

Qu'en statuant ainsi, alors que la nomenclature générale des actes professionnels n'envisage le remboursement des séances de chimiothérapie anticancéreuse par perfusion que si le traitement est effectué dans le cadre d'une structure à compétence carcinologique, le remboursement des perfusions par pompes portables ou implantables étant expressément exclu, de sorte que l'organisme social est fondé à demander la répétition de la différence de cotation correspondant à la part des séances effectuées en traitement ambulatoire en dehors de la structure de soins, le tribunal a violé les textes susvisés ;

Vu l'article 627 du nouveau code de procédure civile ;

PAR CES MOTIFS :

CASSE ET ANNULE, dans toutes ses dispositions, la décision rendue le 26 mai 2005, entre les parties, par le tribunal des affaires de sécurité sociale de Paris ;

DIT n'y avoir lieu à renvoi ;

Déboute M. X... de son opposition formée contre la contrainte délivrée le 20 novembre 2003 ;

Condamne M. X... aux dépens tant devant les juges du fond que devant la Cour de cassation ;

Dit que sur les diligences du procureur général près la Cour de cassation, le présent arrêt sera transmis pour être transcrit en marge ou à la suite de la décision cassée ;

Ainsi fait et jugé par la Cour de cassation, deuxième chambre civile, et prononcé par le président en son audience publique du dix-sept janvier deux mille sept.
