Labor Contract Transfer Dispute Appeal Rejected
Synthèse Legislator
Généré par l'IAThe Supreme Court rejected an appeal concerning a labor dispute where the lower court ruled that the employment contract of an employee had not been transferred to the appealing company. The court found the first ground of appeal inadmissible because it only challenged the finding that the contract was not transferred to that specific company, failing to challenge the operative part of the judgment which dismissed that company from the proceedings, and deemed the second ground insufficient to warrant admitting the appeal.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Sur le premier moyen :
Attendu, comme le fait valoir le mémoire en défense de la société Académy, que le moyen est inopérant dès lors qu'il se borne à reprocher à la cour d'appel d'avoir décidé que le contrat de travail de la salariée n'avait pas été transféré à la société Académy, et ne critique pas la mise hors de cause de cette société décidée dans le dispositif de l'arrêt attaqué (Bordeaux, 27 juin 2005) ;
Et attendu qu'il n'y a pas lieu de statuer sur le second moyen qui ne serait pas de nature à permettre l'admission du pourvoi ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Wel.Com aux dépens ;
Vu l'article 700 du nouveau code de procédure civile, rejette la demande de la société Académy ;
Vu les articles 37 de la loi du 10 juillet 1991 et 700 du nouveau code de procédure civile, condamne la société Wel.Com à verser à Me X... la somme de 2 000 euros ;
Ainsi fait et jugé par la Cour de cassation, chambre sociale, et prononcé par le président en son audience publique du quinze décembre deux mille six.
