Withdrawal of Principal and Incidental Appeals After Report Filing
Synthèse Legislator
Généré par l'IAThe Court of Cassation acknowledged the principal appeal filed by a company, represented by its appointed agent, against a decision rendered by the Versailles Court of Appeal, and further noted the subsequent declaration by the opposing company to waive its cross-appeal and claims for costs under Article 700 of the New Code of Civil Procedure. Finding that both the principal appellant's withdrawal and the respondent's waiver occurred after the report had been filed on January 24, 2007, the Court officially recorded the withdrawals of both the main and incidental appeals, while ordering the principal appellant's representative to bear the costs.
