Appeal Against Stay of Proceedings Pending Labor Tribunal Ruling
Synthèse Legislator
Généré par l'IAThe case involves an appeal by one party against a lower court's decision to stay proceedings pending a ruling from a labor tribunal concerning the existence of an employment contract between the parties, with the appellant arguing the stay was improper. The high court dismissed the appeal, reasoning that under relevant civil procedure articles, a final decision granting a stay of proceedings is only reviewable by the high court for a violation of a rule of law, and since the stay in this instance was granted not based on a specific legal rule but as an exercise of the judge's discretionary power for the proper administration of justice, the appeal challenging the stay on other grounds was inadmissible.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Sur le moyen unique :
Vu les articles 380-1 et 537 du nouveau code de procédure civile ;
Attendu qu'il résulte de ces textes que la décision de sursis à statuer rendue en dernier ressort ne peut être attaquée par la voie du pourvoi en cassation que pour violation de la règle de droit ;
Attendu que M. X... a formé un pourvoi en cassation contre un jugement rendu par le tribunal d'instance de Calais qui a sursis à statuer dans le différend l'opposant à M. Y..., au motif que le conseil de prud'hommes était déjà saisi du litige ayant pour objet l'existence d'un contrat de travail entre les parties ;
Mais attendu qu'il résulte du jugement attaqué que le sursis à statuer a été décidé non pas en application d'une règle de droit mais dans l'exercice du pouvoir discrétionnaire du juge en vue d'une bonne administration de la justice ;
Que le moyen est donc irrecevable ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Ainsi fait et jugé par la Cour de cassation, chambre sociale, et prononcé par le président en son audience publique du quatre avril deux mille sept.
