AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que, par acte déposé au greffe de la Cour de cassation le 6 juin 2006 la SCP Waquet, Farge et Hazan, avocat à cette cour, a déclaré au nom de M. X... se désister purement et simplement du pourvoi formé par lui contre une décision rendue par la cour d'appel de Rennes le 1er février 2005 au profit de Mme Y... ;
Mais attendu que ce désistement est intervenu après le dépôt du rapport ; que dès lors, aux termes de l'article 1026 du nouveau code de procédure civile, le désistement doit être constaté par arrêt ;
PAR CES MOTIFS :
DONNE ACTE à M. X... de son désistement de pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau code de procédure civile et les articles 37 et 75 de la loi du 10 juillet 1991, rejette les demandes ;
Ainsi fait et jugé par la Cour de cassation, première chambre civile, et prononcé par le président en son audience publique du onze juillet deux mille six.
