Logistics Company v. Director General of Customs and Indirect Duties: Withdrawal of Appeal Acknowledged
Synthèse Legislator
Généré par l'IAIn a matter where an appeal was filed against a decision by the Paris Court of Appeal concerning a dispute between a logistics company and the Director General of Customs and Indirect Duties, the Supreme Court took formal note of the appellant's unilateral withdrawal from the appeal. The Court reasoned that pursuant to the relevant procedural code, any withdrawal before the Supreme Court occurring after the rapporteur's report had been filed must be formally acknowledged by a judgment, leading the Court to grant the appellant's declaration of withdrawal while ordering them to pay costs and acknowledging the respondent's withdrawal of their counterclaim.
