Public Equipment Office v. Individual (Water Bill Prescription)
Synthèse Legislator
Généré par l'IAIn a dispute concerning the recovery of unpaid water bills by a public equipment office against an individual, the lower court ruled that the two-year prescription period established by the Civil Code was applicable, prompting the office to appeal, arguing that the relevant public finance code limited the application of such short prescription periods only to administrative debts. The Court of Cassation rejected the appeal, affirming the lower court's decision by holding that the two-year limitation period for merchants selling goods to non-merchants, as stipulated in the Civil Code, was correctly applied to the action for the recovery of water supply charges initiated by the office.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que dans l'instance opposant Mme X... à l'Office d'équipement hydraulique de Corse (l'Office) pour le recouvrement par le comptable public de factures d'eau, le jugement attaqué (tribunal d'instance de Bastia, 21 janvier 2002) a jugé que la prescription biennale de l'article 2272 du Code civil était applicable ; que l'office fait grief à cette décision d'avoir ainsi statué, alors, selon le moyen, qu'en limitant le champ d'application de l'article L. 1617-5 du Code général des collectivités territoriales aux seules créances administratives, le Tribunal a violé cette disposition ;
Mais attendu que les dispositions du quatrième alinéa de l'article 2272 du Code civil sont applicables à l'action des marchands pour les marchandises qu'ils vendent aux particuliers non marchands ;
que, s'agissant d'une action en recouvrement de fourniture d'eau engagée par l'office, le Tribunal a exactement décidé que la prescription biennale prévue par ce texte était applicable ; que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne l'Office d'équipement hydraulique de Corse aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du six juillet deux mille cinq.
