Succession Sharing Rules and Unregistered Partnerships
Synthèse Legislator
Généré par l'IAThe appellant claimed that the rules for succession sharing, including preferential attribution, should apply to the division of an unregistered partnership (société de fait) formed between cohabiting partners, arguing the appellate court erred by only denying preferential attribution in conventional cohabitation indivision without investigating the application of partnership sharing rules. The Court of Cassation rejected the appeal, finding the argument regarding the application of partnership sharing rules to be new and inadmissible because it was not raised before the court of appeal, making the point a mixture of fact and law that could not be considered on appeal.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que M. X... fait grief à l'arrêt attaqué (Paris, 16 septembre 2003), d'avoir confirmé le jugement entrepris en ce qu'il a rejeté sa demande d'attribution préférentielle alors, selon le pourvoi, que les règles concernant le partage des successions, y compris l'attribution préférentielle, s'appliquent au partage d'une société de fait formée entre les concubins ; qu'en se bornant à affirmer qu'il n'y a pas de faculté d'attribution préférentielle en matière d'indivision conventionnelle entre concubins, sans rechercher si, comme le soutenait M. X... dans ses conclusions d'appel, il y avait lieu à application des dispositions relatives au partage des sociétés, la cour d'appel a privé sa décision de base légale au regard des articles 1844-1, 1844-9, 1871-1 et 1873 du Code civil ;
Mais attendu qu'il ne résulte ni de l'arrêt ni des pièces de la procédure, que M. X... avait soutenu devant la cour d'appel qu'il y avait lieu à application des dispositions relatives au partage des sociétés ; que le moyen est donc nouveau et, mélangé de fait et de droit, irrecevable ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-deux novembre deux mille cinq.
