Municipality Road Work Water Infiltration Damage Liability
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal stemming from damage caused by water infiltration originating from exterior road work performed by the municipality, noting that an expert report confirmed the source of the infiltration and that the defective manhole cover had been replaced. The appellate court properly determined that no construction defect or maintenance failure could be attributed to the co-owners' association because the only identified issue with the collective drainage system—a tee needing replacement—was not proven to be leaking, leading to the conclusion that the association bore no liability.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant relevé qu'il résultait de l'expertise judiciaire que des infiltrations d'eau provenant de l'extérieur du bâtiment s'étaient produites à la suite des travaux réalisés sur la voirie par la ville de Paris, que le tampon défectueux avait été changé, qu'aucun défaut d'entretien ne pouvait être reproché au syndicat des copropriétaires, que le "té" d'évacuation collective , dont il n'était pas établi qu'il était fuyard mais seulement à changer, l'avait certainement été, la cour d'appel a pu en déduire qu'aucun vice de construction ou défaut d'entretien n'était établi à l'encontre du syndicat des copropriétaires ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du treize septembre deux mille cinq.
